Macon Councilman Henry Gibson’s challenge to Macon-Bibb County commission candidate Al Tillman’s residency “appears to be a moral objection rather than a legal one,” an attorney wrote.
A Superior Court judge may soon decide whether Tillman should be removed from his District 9 candidacy. Tillman has a home in District 8, but the Board of Elections ruled 4-0 that an apartment he’s renting is his home. Gibson is appealing the decision that backed Tillman.
Board of Elections attorney William H. Noland warned of “a dangerous precedent” if Gibson is allowed to re-open his case only because he didn’t like the outcome.
In contrast, Gibson’s lawyer said the elections board never inquired whether Tillman had a business, where it was, or whether it was licensed. Attorney Charles E. Cox wants the judge to order the Board of Elections to hold a hearing by Friday.
