Court Of Appeals Dismisses Some Charges Against Former Cobb EMC CEO But Refused To Toss Indictment

A panel of the state Court of Appeals has tossed a few of the criminal charges against former Cobb EMC chief executive officer Dwight T. Brown but rejected his other arguments aimed at a July 2011 indictment as a whole.

The panel of Judges Gary Andrews, Stephen Dillard and Carla Wong McMillian said Thursday that a Cobb County trial judge should have dismissed four charges against Brown that were based on the filing of a lawsuit against people who allegedly cooperated with the prosecution in his criminal case. But the appeals panel rejected arguments by Brown, who has been charged with racketeering and theft for his actions as CEO of the nonprofit electric membership cooperation and its for-profit subsidiaries, that the indictment should be tossed because the trial court had no jurisdiction over the indictment while an earlier indictment remains on appeal and because members of the Cobb EMC who are victims of Brown’s alleged crimes sat on the indicting grand jury.
