With Mayor J. Max Davis announcing his candidacy for State House District 80 in the July 14 Special Election, his seat as Mayor of Brookhaven will become vacant when he qualifies. This gave me a reason to look at the City Charter.
(b) A vacancy in the office of mayor shall be filled for the remainder of the unexpired term by a special election if such vacancy occurs 12 months or more prior to the expiration of the term of that office. If such vacancy occurs within 12 months of the expiration of the term of that office, the city council or those members remaining shall appoint a successor for the remainder of the term. This provision shall also apply to a temporary vacancy created by the suspension from office of the mayor.
Rumor on the street is that Rebecca Chase-Williams is likely to be appointed as Mayor for the remainder of J. Max’s term, which would open a vacancy on City Council for District 1.
(c) A vacancy in the office of a councilmember shall be filled for the remainder of the unexpired term by a special election if such vacancy occurs 12 months or more prior to the expiration of the term of that office. If such vacancy occurs within 12 months of the expiration of the term of that office, the mayor shall appoint a successor for the remainder of the term subject to the approval of the city council or those members remaining.
We are within 12 months of the expiration of the current District One city council member’s term in office, which ends after the 2015 election, so the mayor at the time a city council seat becomes vacant will appoint a successor for the remainder of 2015. (§2.02(3)(d)) says,“The terms for the candidates elected for Council Districts 1 and 3 shall expire upon the administration of the oath of office to their successors elected in the regular elections held in November, 2015.”
